Certificate of Occupancy
Required- Certificate
- Rental / Resale Certificate (continuing certificate of occupancy) for one- and two-family homes

- Borough of New Milford Building Department (Construction Official), with Public Works (sidewalks), Zoning and Fire sign-offs
- Requirements
- All open permits closed and final inspections done (water heater, furnace, AC, renovations, decks, pools); unpermitted work needs permits
- Smoke detector on each level including walk-up attic and basement; 10-year sealed battery type
- Carbon monoxide detector within 10 feet of the bedroom areas in the hallway (more if bedrooms are in separate areas)
- Sump pump may not drain into the sanitary sewer line
- Handrails on any steps with 3 steps and a platform (two handrails if wider than 3 feet)
- Bedroom windows must operate properly
- House numbers visible from the street
- Hydrant on the property visible and not blocked
- Property neat and clean, no excessive debris or overgrown shrubs
- Sidewalks and aprons must comply; DPW inspects; repairs or a buyer's attorney escrow letter (repair within 30 days of closing)
- Secondary power sources (generator, solar) labeled near the main panel and meter
- Running bamboo must be disclosed and, if uncontained, abated or escrowed
- Application asks about oil tanks, private wells (safety/health test) and sump pumps
- For a demolition sale, a buyer's attorney letter is needed and smoke/CO inspection is still required

- Schedule all inspections at least two weeks before closing. Inspections are Monday or Thursday, 1:00 to 4:00 pm. Code says the Construction Official acts within 10 days of the application.

Smoke and CO alarm certificate
Required- Requirements
- Smoke detector on each level including walk-up attic and basement
- Battery smoke detectors must be 10-year sealed units listed to ANSI/UL 217 (hardwired units are not affected)
- Carbon monoxide detector within 10 feet of the bedroom areas in the hallway; extra units if bedrooms are in separate areas
