Fair Chance in Housing Act
A 2021 New Jersey law that stops most landlords from asking about your criminal record until after they make you a conditional offer, and limits which records they can consider. Owner-occupied buildings with four or fewer units are exempt.
New Jersey example
You apply for an apartment in a large Newark building. The application can't ask about criminal history. After a conditional offer, the landlord can consider only certain convictions, such as a fourth-degree conviction from within the past year, and can never count an arrest without a conviction, or an expunged or juvenile record. Complaints go to the NJ Division on Civil Rights.
