Certificate of Occupancy Required

Resale Existing Structure Certificate of Occupancy · Ocean Gate Borough Construction / Code / Zoning office (Borough Official Inspector)

  • Visual inspection of structural and sanitary conditions, fire safety precautions, and any maintenance or zoning violations under Borough ordinances
  • Smoke and carbon monoxide alarms (the form says they are required by law)
  • Fireplace and furnace certificates must be submitted with the application
  • Flood Elevation Certificate (1988 datum) if the home is in an effective or preliminary flood hazard zone
  • An adult must be present at the inspection

Smoke and CO alarm certificate Required

  • Smoke alarms on each level and outside each separate sleeping area (Borough-posted N.J.A.C. 5:70-4.19 sheet)
  • Battery-only smoke alarms must be 10-year sealed battery units; AC-powered alarms from the original construction must not be replaced with battery alarms
  • Carbon monoxide alarm in the immediate vicinity of the sleeping areas (not needed if the building has no fuel-burning device and no attached garage)
  • The Borough-posted sheet (effective January 1, 2019) still lists a portable fire extinguisher (2A-10B:C, no more than 10 pounds, within 10 feet of the kitchen, mounted on its bracket, top no more than 5 feet above the floor, serviced within 12 months or with a recent receipt); state law P.L.2025, c.19 (February 3, 2025) removed the extinguisher from the state requirement
