Certificate of Occupancy Required

Certificate of Habitability (CH) for residential property sale, with Zoning Review and Fire Safety Certification · Town of Morristown Division of Housing & Property Maintenance, with a Zoning Review by the Zoning Officer

  • Habitability inspection of the exterior (fences, garage, sheds, chimneys, foundation, gutters, landscaping, paint, roof, sidewalks, stairs with railings for three or more treads, no pests)
  • Interior checks: asbestos encapsulated or removed, dry basement, bathroom ventilation, CO detectors, walls and ceilings, two working outlets in each habitable room, fireplace with proof of last flue cleaning, floors, furnace, GFCI outlets in kitchen and baths, water heater, kitchen ventilation to the outside, plumbing, smoke detectors, first-floor window sash locks
  • Satisfactory Zoning Review by the Zoning Officer for each dwelling unit
  • No CH while any construction permit is open
  • Occupancy Standard Form signed by seller, buyer and buyer's agent, returned to Housing & Property Maintenance
  • Purchaser and real estate licensee certifications about the maximum number of occupants
  • Pre-1981 dwellings that are not a primary residence must register with the Rent Leveling department
  • Fire extinguisher in each kitchen for 1-3 family homes (form still lists it)

Smoke and CO alarm certificate Required

  • Smoke alarms on each level and outside each separate sleeping area (NFPA 72); 10-year sealed battery alarms for homes built before 1977; AC-powered alarms from original construction may not be replaced with battery alarms
  • Carbon monoxide alarm in the immediate vicinity of the sleeping areas in homes with a fuel-burning device or attached garage (battery, hardwired or plug-in, UL 2034)
  • Portable fire extinguisher, 2A-10B:C, no more than 10 lbs, within 10 feet of the kitchen, mounted with the maker's bracket, top no more than 5 feet up, serviced and tagged in the past 12 months or with a recent receipt (form still lists it)
  • Seller signs an attestation that alarms are installed and working and all building permits are closed
