Certificate of Occupancy Required

Certificate of Resale Compliance (formerly Transfer of Title certificate, TOT) · City of Asbury Park Department of Community Development / Code Enforcement

  • Application and inspection before the closing of title
  • Inspection against the City's Property Maintenance Code (interior and exterior checklist: paint, windows and screens, handrails, GFI outlets, heating, plumbing, sidewalks and steps, house numbers and more)
  • Smoke detector on each level and within 10 feet of every bedroom; photoelectric within 5 feet of a kitchen or bathroom
  • Carbon monoxide detectors outside all bedrooms, within 10 feet of every bedroom
  • All open construction (UCC) permits must have a passed final inspection on file before the inspection
  • Fireplaces and wood stoves certified by a certified chimney sweep
  • The office checks open permits, available COs and the number of units with the Tax Assessor, Clerk, Code Enforcement and Construction offices
  • A buyer of a property with an open compliance order or notice of violation must sign a notarized statement accepting responsibility for the repairs (Code PM-106.5)
  • Application by someone other than the owner or registered agent needs a notarized authorization letter
