Certificate of Occupancy Required

Certificate of continued occupancy (Certificate of Resale / Rental Compliance) · Borough of Helmetta Code Enforcement (Code Enforcer / Fire Marshal)

  • Smoke alarms on all levels including attic spaces and basements; 10 year sealed battery or hardwired interconnected, less than 10 years old
  • Smoke and CO alarms within 10 feet of all sleeping areas (the resale packet copy says CO alarms less than 7 years old; the separate checklist says less than 10)
  • Walls, floors and ceilings in good condition, no holes
  • Working kitchen and bathrooms: hot and cold water with shut-off valves, drain traps, toilets secured with shut-off valve
  • Anti-tip device on stoves
  • Outlets, junction boxes and electrical equipment working with cover plates; panel openings closed; service cable secured
  • Water heater, boiler, furnace and HVAC working and vented; replacements must have a construction permit
  • Fireplaces, wood stoves and chimneys maintained
  • Exit doors working; no double keyed deadbolts (thumb-latch locks)
  • Windows operate; no broken panes or torn or missing screens
  • Gutters, leaders, roof and foundation in good repair
  • No extension cords used as permanent wiring (garage door openers, sump pumps and appliances plugged directly into outlets)
  • All open construction permits finalized
  • House numbers at least 4 inches high, visible from the curb; handrails on stairs with 3 or more risers
  • Yard maintained; pools protected with fences and self-closing, self-latching gates

Smoke and CO alarm certificate Required

  • Smoke alarms: 10 year sealed battery type or hardwired interconnected, less than 10 years old, on all levels including attics and basements
  • CO alarms within 10 feet of all sleeping areas (less than 7 years old per the resale packet checklist)
  • The Borough resale smoke/CO form (January 2025) and fire checklist still list a fire extinguisher; they were written before P.L.2025, c.19 removed the state extinguisher requirement, so confirm with the Fire Marshal
